Terms of Service

The short version. You pay once and the app is yours to keep, on every Mac you personally use, forever. If you want your money back within thirty days, you get it, no questions asked. Do not resell it, and do not record people who have not agreed to be recorded.
These terms govern your purchase and use of AirCheck for macOS. Your counterparty is Hannes Hennerbichler, Kantstraße 1, 30625 Hannover, Germany (mail@hanneshennerbichler.de).
1. What you are buying
AirCheck is a macOS application that records your Mac's own audio output to a WAV or MP3 file on your disk. It requires macOS 14 or later. A single purchase of US$39 buys one perpetual licence key.
This is a one-off payment. There is no subscription, no recurring charge, and no expiry date on the licence.
2. What the licence lets you do
You get a personal, worldwide, non-exclusive, non-transferable licence to install and use AirCheck on any Mac that you own or personally control, including your laptop and your studio machine. You may use it commercially — for client work, for released music, for anything you are paid for — at no extra cost and with no revenue share.
Recordings you make with AirCheck are yours. I claim no rights over your output.
3. What the licence does not let you do
- Share, resell, sublicense, publish or give away your licence key.
- Deploy the app across an organisation on one key. If you need seats for a team, email me and I will sort out a fair price.
- Remove or work around the licence check, or distribute a modified build.
- Reverse engineer the app, except to the extent that this cannot lawfully be prohibited under §69e UrhG or Art. 6 of Directive 2009/24/EC.
A key that shows up in public gets revoked. If that happens to a key you paid for because someone else leaked it, tell me and I will reissue yours.
4. Recording responsibly
AirCheck captures whatever your Mac plays. That includes calls, meetings and livestreams involving other people. Whether you are allowed to record them is your responsibility, not mine. Consent rules differ sharply between countries and between US states, and in several of them recording a conversation without telling everyone in it is a criminal offence.
You agree to use AirCheck lawfully, and to obtain any consent that applies where you and the other participants are. I provide the tool; I have no way of knowing and no control over what you point it at.
5. Refunds
Thirty days, no questions asked. Email me, say you want a refund, and I will send the money back to your original payment method. I will probably ask what went wrong, but answering is optional and the refund does not depend on it.
Your licence key stops working once a refund is issued. This policy is deliberately more generous than the 14-day right of withdrawal you hold as an EU consumer under §355 BGB, and it does not replace or reduce that right.
6. Delivery
Your licence key is emailed to the address you enter at checkout, normally within a minute of payment. If it does not arrive, check your spam folder and then use the key recovery page, which will resend it to the same address. If that fails, email me and I will look it up by hand.
7. Availability of the licence server
Activation requires a one-time connection to the licence server. Once activated, the app runs offline indefinitely.
If I ever shut AirCheck down, I will publish a final build that needs no activation at all, so that a licence you paid for does not die with the website. That is a commitment, not a courtesy.
8. Warranty
AirCheck is provided as it is. I have tested it on the hardware I own and I fix reported bugs, but I cannot warrant that it will be free of defects or that it will work with every combination of macOS version, audio interface and third-party driver.
Your statutory warranty rights as a consumer under German law are unaffected by anything in this section.
9. Liability
I am liable without limit for damage caused intentionally or by gross negligence, for injury to life, body or health, and under the Produkthaftungsgesetz. For ordinary negligence I am liable only for breach of an obligation essential to the contract, and only up to the damage typically foreseeable for a contract of this kind.
Beyond that, and in particular for lost recordings, lost session material or lost income, liability is limited to the amount you paid for the licence.
Back up anything you cannot afford to lose. A recorder is not an archive.
10. Changes to these terms
I may update these terms for future purchases. The terms you agreed to on the day you bought your licence continue to apply to that licence. Changes are never applied retroactively to a purchase you have already made.
11. Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this does not deprive you of the protection of the mandatory law of the country where you live.
The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr. I am not obliged to participate in dispute resolution proceedings before a consumer arbitration board, and I prefer to just sort the problem out over email.
